RETURNS AND REFUNDS POLICY

2. PURPOSE

The sale of products by MAGSAN REPRESENTACIÓN Y DISTRIBUCIÓN, SCP (hereinafter MAGSAN) is governed by these General Terms and Conditions of Sale.

These General Terms and Conditions of Sale are deemed accepted without reservation by the Customer and shall prevail over any general purchasing conditions of the Customer.

MAGSAN reserves the right to update and/or modify these General Terms and Conditions of Sale at any time without prior notice. Customers are advised to review them periodically. MAGSAN shall not be liable to the Customer or to third parties for such modifications.

3. PRODUCT SELECTION

The Customer is solely responsible for selecting the product and for determining its intended use or application. Accordingly, MAGSAN does not guarantee that the product is suitable for the specific technical applications intended by the Customer or that it will meet the objectives sought.

4. SALES PRICES

MAGSAN prices are considered retail prices and do not include applicable taxes in accordance with current tax legislation.

Prices shall remain valid until a new price list is issued. MAGSAN reserves the right to modify prices, sales conditions, and product catalogues without prior notice.

5. ACCOUNT OPENING AND PAYMENT TERMS

The first transaction must be paid in advance via virtual POS, bank transfer, or cash on delivery.

After the first transaction, the Customer may request the opening of a credit account, subject to approval.

6. TRANSPORT

Within the Iberian Peninsula, shipments will be prepaid provided the minimum order amount is met. Otherwise, shipping costs will be borne by the Customer.

Any claim for damage or loss must be submitted within 48 hours of shipment. After this period, MAGSAN shall not be liable.

7. DELIVERY TIMES

Delivery times are indicative only. No compensation shall be due for delays.

Product availability is subject to stock levels at MAGSAN and its suppliers.

8. FORCE MAJEURE

In cases of force majeure, MAGSAN may delay or cancel orders without liability.

9. RETURN OF GOODS

No returns will be accepted without prior authorization from MAGSAN. Returned goods must be properly identified using the return label provided.

The Customer has 30 days from the shipment date to request a return.

10. RETURN OF DEFECTIVE GOODS UNDER WARRANTY

The warranty period is one year from the date of purchase.

The warranty does not cover damage caused by misuse, improper installation, wear and tear, or unauthorized modifications.

11. LATE PAYMENT

Late payments will accrue statutory interest applicable to commercial debts.

Persistent non-payment entitles MAGSAN to demand immediate payment and suspend deliveries.

12. RETENTION OF TITLE

All goods remain the property of MAGSAN until full payment has been received.

13. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.

Any disputes shall be submitted to the Courts of Barcelona, Spain.
